Parsippany developer Edward Mosberg was indicted today by a federal grand jury that charged him with paying off a township official to advance construction projects in Morris County's biggest town. [Morris County is a center of Orthodox Jewish communities where they used to hang LIVE chickens in the kosher butchers' windows (on hooks?), see here]
The charges handed up in Newark allege the 82-year-old builder gave discounts on homes he sold to planning board attorney John Montefusco Sr. and his family, in exchange for official favors from 1987 to 2007.
Montefusco admitted the charges in February. In turn, family members were allowed to make a bigger profit on the buildings that they "flipped" to others.
The indictment brings to a climax an investigation that has resulted in guilty pleas by three other township officials since the matter came to light 21 months ago.
Mosberg's attorney, Peter Till, said he has not yet seen the documents and declined to comment other than to say his client "will enter a plea of innocent when he goes into court."
Mosberg was charged with one count of conspiracy to commit mail fraud, six counts of mail fraud and four counts of bribery. He will be arraigned in the next two weeks.
The conspiracy to commit mail fraud, as well as each mail fraud count, carry a statutory maximum penalty of 20 years in prison. Each bribery count carries a maximum term of 10 years in prison. All the counts carry a maximum fine of $250,000.
Mosberg's indictment was expected since February, when planning board attorney John Montefusco Sr., 68, had to resign after pleading guilty to accepting $26,000 in exchange for doing favors for Mosberg. He also admitted tailoring the pace and outcome of litigation for Mosberg's benefit.
His son, John Montefusco Jr., 41, resigned from the board of education before he admitted in June that he reported neither the $97,576 profit he made on the sale of two homes Mosberg permitted him to "flip," nor the $43,950 worth of upgrades Mosberg provided for his own home.
